By applying to and participating in the DriveLabs Affiliate Program (“Program”), you (“Affiliate”, “you”) agree to abide by the following terms and conditions (“Terms”). These Terms form a legally binding agreement between you and DriveLabs (“Company”, “we”, “us”, “our”).
1. Program Overview
The DriveLabs Affiliate Program enables approved affiliates to earn commissions by referring sales through unique affiliate links provided by the Company.
We are committed to building partnerships with responsible affiliates who promote our products with integrity and in line with applicable laws and advertising standards.
2. Eligibility
- You must be at least 18 years old to participate in the Program.
- Applications are subject to review and approval by DriveLabs.
- We reserve the right to accept or reject any application at our sole discretion, with or without reason.
3. Commissions & Cooldown Period
Commission Rate
- Affiliates will earn a commission of [Insert %] of the net sale amount (excluding taxes, shipping, discounts, refunds, chargebacks).
- Net sale amount is calculated after any applicable fees or deductions.
Cooldown Period
- A 7-day cooldown period applies to all new purchases.
- Commissions on sales will only be approved and eligible for payout after an order has remained completed and free from refunds, disputes, or chargebacks for 7 full days from the purchase date.
- If an order is refunded, cancelled, or results in a chargeback, no commission will be paid on that transaction.
Commission Validity
- You will only earn commission on sales that are tracked and reported through our affiliate system.
- DriveLabs is not responsible for tracking errors caused by customer actions such as ad blockers, private browsing, or cookie blocking.
4. Payouts
- Payouts are processed on the 1st of each calendar month.
- Payouts include all eligible, approved commissions earned up to the end of the prior month, subject to the 7-day cooldown period.
- The minimum payout threshold is $50 AUD. If your balance is below this amount, it will roll over to the next month.
- Payments are made via [affiliates choice of payment]. You are responsible for ensuring your payment details are accurate.
- Any commissions earned on fraudulent, cancelled, or refunded orders will not be paid and may be deducted from your future payouts.
5. Prohibited Conduct
Affiliates must not engage in any of the following activities:
- False or misleading claims: You may not promote DriveLabs products with any false, misleading, or unsubstantiated claims (including health or medical claims).
- Non-compliant advertising: You must promote our products strictly for research purposes only. You may not advertise or suggest our products are for human consumption or therapeutic use.
- Trademark bidding: You may not run paid search ads targeting DriveLabs branded terms, including variations or misspellings.
- Spam: You may not engage in unsolicited email marketing or spam.
- Misrepresentation: You may not misrepresent your relationship with DriveLabs or present yourself as an employee or official representative of our company.
Any violation of the above will result in immediate termination from the Program and forfeiture of all unpaid commissions.
6. Content Standards & Compliance
- You must comply with all applicable laws, advertising standards, and platform policies (including but not limited to Facebook, Instagram, Google, and TikTok).
- You must clearly disclose your affiliate relationship when promoting DriveLabs products, as required by the Australian Consumer Law (ACL) and other applicable guidelines (e.g. “This post contains affiliate links”).
- DriveLabs reserves the right to review your promotional materials and require changes to ensure compliance with these standards.
7. Termination
- Either party may terminate your participation in the Program at any time, with or without cause, by providing written notice (including email).
- DriveLabs reserves the right to immediately terminate your participation for violations of these Terms, fraudulent behaviour, or conduct deemed harmful to our brand or reputation.
- Upon termination, any unpaid commissions on ineligible or disputed transactions will be forfeited.
8. Limitation of Liability
- DriveLabs shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from your participation in the Program.
- Our total liability under this Program shall not exceed the total commissions paid to you under these Terms.
9. Changes to the Terms
- DriveLabs may update or modify these Terms at any time, at its sole discretion.
- Continued participation in the Program after changes are published constitutes acceptance of the updated Terms.
10. General
- You are participating in the Program as an independent contractor, not an employee or agent of DriveLabs.
- These Terms constitute the entire agreement between you and DriveLabs regarding the Program and supersede all prior agreements.
